An unpaid invoice, a loan not repaid, rent in arrears? Legal Field Avocats recovers your debts in Senegal, for companies, individuals and creditors based abroad.
Who we act for
- Companies: unpaid invoices between businesses, defaulting customers;
- Individuals: private loans, unpaid rent, maintenance payments;
- Foreign creditors: a company or an individual based in France or elsewhere who needs to recover a debt in Senegal.
The stages of recovery
- The amicable phase: formal notice from a lawyer, negotiation, payment schedule.
- The order for payment (injonction de payer) under the OHADA Uniform Act on simplified recovery procedures and enforcement measures: it allows the recovery of a debt that is certain, of a fixed amount and due, arising from a contract or from a bill of exchange or an unpaid cheque. The debtor has fifteen days from service to lodge an objection.
- Attachments: conservatory attachments to freeze the debtor’s assets before judgment, then enforcement attachments once an enforceable title is obtained.
You are a creditor abroad
If you have already obtained a judgment abroad, it must in principle be declared enforceable in Senegal (exequatur) before any attachment, subject to applicable conventions such as the Franco-Senegalese judicial cooperation convention. We represent you in Senegal without you having to travel.
